How to update our BAA Agreement

    Hi We have recently upgraded our account to a Gold license and with that we can sign a BAA. However our legal team has reviewed it, and we are hoping to see if we can make a few changes.

    From a legal perspective, can we remove this line, as we will not use your services to aggregate data?

    • 2.3. Use of PHI for Data Aggregation. Except as otherwise limited in this HIPAA BAA, JotForm may use PHI to provide Data Aggregation services to Customers consistent with 45 C.F.R. §164.504(e)(2)(i)(B).

    And add:

    • Until the expiration of four years after the furnishing of its services, it shall make available, upon written request to the Secretary of Health and Human Services, or upon request by the Comptroller General of the United States, or any of their duly authorized representatives, the contract, and its books, documents, and records that are necessary to verify the nature and extent of its service fees.

    Thanks for reaching out to Jotform Support. I understand that you would like to modify your BAA, but please note that BAA can't be modified for regular accounts. Custom BAA is only available on our Enterprise plan.
