Can visitors/users of a certain form only be added to a Mailchimp list if the visitor/user says it's ok? For example, it only adding them to a Mailchimp list if they have checked a check box that asks them if they would like to receive our newsletter, and not add them if they do not check the box.

You can make use of the Conditional Logic to show the email address field which is to be used for the mailing list. When users check the box for subcsription they will be prompted to enter the email address which would be used for the mail list. If you have other email fields in the form then make sure that in the mailchimp integration wizard the email address set is the mailing list subscription email field.
Feel free to clone the following form in your account to see how it works:

We will consider your suggestion for the future updates. I think it makes sense to let users choose to be included in the newsletter.

It is actually a requirement of MailChimp that the visitor choose to be opted in (either through something like actually entering their email for the sole purpose of opting in, selecting the option to be added, or buying from you and being added to a list of customers).

Thanks for informing us about this. We will then prioritize this.

+1 for this request. We have a lot of forms for competitions. The user already has to enter their details (email / name) to enter the comp. So I'd rather not have a second set of inputs for the mailchimp integration.
Basically mailchimp integration should be conditional upon ticking the "I would like to join the mailing list" button.
