What is Form 1099-S?
Form 1099-S, Proceeds From Real Estate Transactions, reports the sale or exchange of real estate, such as land, houses, condos, and commercial buildings. It shows the gross proceeds paid to the seller (called the transferor), who uses it when reporting the sale on their tax return.
Who is responsible for filing Form 1099-S?
Generally the person responsible for closing the transaction files it, which is usually the settlement agent listed on the Closing Disclosure. If there isn't one, responsibility passes in a set order through the attorneys, the title or escrow company, the mortgage lender, the brokers, and finally the buyer. The parties can also name a filer in a written designation agreement.
Does every home sale need a Form 1099-S?
No. Reporting generally isn't required for the sale of a principal residence when the seller gives the filer a written certification that the full gain is excludable under section 121 and the sale price is within the limits in the instructions. Other exceptions apply, so check the current Instructions for Form 1099-S.
When is Form 1099-S due?
The seller's copy is generally due by February 15 of the year after the sale. The IRS copy is usually due by the end of February on paper or March 31 if you e-file. Many filers are required to e-file, and a red Copy A printed from a PDF can't be filed on paper, so confirm the requirements in the current instructions.
How do I fill out Form 1099-S?
Enter the filer's name, address, phone number, and TIN, followed by the transferor's name, address, and TIN. Box 1 is the date of closing, and the gross proceeds box shows the total the seller received. The newest revision of the form splits gross proceeds into cash and digital asset amounts.
Box 3 is the property address or legal description. You'll also report the buyer's part of the real estate tax and check any boxes that apply, such as when the seller received property or services as part of the payment.
