Generally, you file Form 709 if you gave any one person gifts worth more than the annual exclusion during the year, gave a gift of a future interest, or want to split gifts with your spouse. The annual exclusion amount changes, so check the current instructions.
Each spouse files their own Form 709. There's no joint gift tax return.
Will I owe gift tax if I file Form 709?
Most people who file Form 709 don't owe any gift tax. Taxable gifts are usually applied against your lifetime exemption first, and tax is only due once that's used up. Filing still matters, since it keeps an accurate record of what you've given.
When is Form 709 due?
Form 709 is generally due April 15 of the year after you made the gift. If you get an extension to file your income tax return, that extension also covers Form 709. You can also request an extension just for the gift tax return with Form 8892.
How do I fill out Form 709?
Part 1 asks for general information, including your name, address, and Social Security number, and whether you're splitting gifts with your spouse. Then list each gift on Schedule A, including who received it, a description, your adjusted basis, the date of the gift, and its value.
Report gifts from earlier years on Schedule B, figure any deceased spouse's unused exclusion on Schedule C, and use Schedule D for generation-skipping transfers. Part 2 pulls everything together to compute the tax.
