It looks like we have reached our submissions limit this month. If we choose to upgrade for 3 months can we go back to the standard "Free" membership after this time or will we be locked into a monthly payment once we have upgraded.

You can upgrade and downgrade your account anytime you see fit.

can you confirm if we was to downgrade at a later date we would not loose any of our submissions or forms that have been previously created?

I can confirm that if you downgrade at a later date, you won't lose any of your submissions.
However, please note that the submissions limit for accounts in the FREE plan is 500 and when you downgrade, you will be able to see only the most recent 500 submissions.
Older submissions can be restored if you decide to upgrade again. If this happens, you can upgrade to the STORAGE plan which is $5/month and it has the same limits as the FREE plan but it has Unlimited Submission Storage.
