What is Form 3949-A?
Form 3949-A, Information Referral, is used to report suspected tax law violations by an individual, a business, or both. Examples include unreported income, false deductions or exemptions, kickbacks, and failing to file a return or pay tax.
Do I have to include my name on Form 3949-A?
No. The part of the form that asks about you is optional, so you can send a referral without identifying yourself. If you do include your information, the IRS keeps your identity confidential.
Keep in mind that, because of privacy laws, the IRS generally can't tell you what action it takes on your referral.
When should I use a different form instead?
Some issues have their own forms. Identity theft is reported on Form 14039, whistleblower award claims go on Form 211, complaints about a tax return preparer use Form 14157, and abusive tax promotions are reported on Form 14242. If you're not sure which one fits, check the Form 3949-A instructions.
Where do I send Form 3949-A?

How do I fill out Form 3949-A?
Section A asks about the individual you're reporting, such as their name, address, and taxpayer ID if you know it. Section B covers a business, including its name, address, and EIN. Fill in whichever section applies and leave blank anything you don't know.
In Section C, check the type of violation, note the tax years and any amounts involved, and describe what happened in your own words. The last section, which asks for your own contact information, is optional.
