What is Form 8862?
Form 8862, Information To Claim Certain Credits After Disallowance, is what you file to claim the earned income credit (EIC), child tax credit, additional child tax credit, credit for other dependents, or American opportunity tax credit after the IRS reduced or disallowed that credit in an earlier year.
When do I need to file Form 8862?
You generally need it if the IRS reduced or disallowed one of these credits for a reason other than a math or clerical error, and you now want to claim it again.
You usually only file it once, for the first year you claim the credit after the disallowance. If the IRS allows the credit that year, you don't need to file it again unless the credit is disallowed again.
Can I be banned from claiming these credits?
Yes. If the IRS decides your earlier claim was due to reckless or intentional disregard of the rules, you can't claim the credit for 2 years. If it was due to fraud, the ban lasts 10 years. You can't use Form 8862 to claim the credit while a ban is in effect.
Where do I send Form 8862?
Attach it to your tax return for the year you're claiming the credit. If the IRS sends you a letter asking for Form 8862, follow the instructions in that letter.
How do I fill out Form 8862?
Start with the tax year you're claiming the credit for and check which credits you're claiming. Part I applies to everyone. Then complete only the parts for your credits: Part II for the earned income credit, Part III for the child tax credit, additional child tax credit, or credit for other dependents, and Part IV for the American opportunity tax credit.
Part V asks about any qualifying child who could also be claimed by someone else. Answer each question carefully, since the IRS uses this information to decide whether you're eligible.
